In the matter of: Sri Suvamoy Kar and another ... petitioners The present revisional application was preferred for quashing the charge-sheet filed in G.R. Case No.2940 of 2014 pending before the ACJM, Barrackpore, under Sections 420, 406, 120B, 34 of the Indian Penal Code.
Record of the revisional application reflects that the only document which has been enclosed along with the revisional application relates to the charge-sheet under Section 173 of the Cr.P.C. which has been filed before the jurisdictional Court.
I do not find from the records that the documents relating to Section 207 of the Cr.P.C. in any way has been enclosed with the revisional application for appropriate adjudication of the case.
The points agitated in the revisional application are all question of facts which cannot be adjudicated at this stage of the proceedings.
Since none appeared on behalf of the State, Mr. Anwar Hossain along with his junior Ms. Debjani Sahu who ordinarily appears on behalf of the State is directed to appear
on behalf of the State. Let his appearance be regularised by the concerned authority.
Accordingly, CRR 286 of 2015 is dismissed, pending application if any is consequently disposed of, interim order if any is hereby vacated.
All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this Court.
