The petitioner does not appear to be one of the three persons who held the victim and shot at him.
It appears that one Jahangir Mondal was a member of the crew who aided the assault. However, the petitioner is Jahangir Islam alias Md. Jahangir Islam and his name does not appear either in the FIR or in the charge-sheet.
In view of the fact that co-accused similarly circumstanced with the petitioner has been granted bail earlier, the petitioner is entitled to the same relief.
Accordingly, prayer for bail is allowed.
The petitioner namely Jahangir Islam alias Md. Jahangir Islam shall be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the Learned Chief
Judicial Magistrate, Barasat subject to condition that he shall appear before the learned Trial Court on every date of hearing and shall not intimidate witnesses and/or tamper with evidence in any manner whatsoever.
In the event the petitioner fails to appear before the learned Trial Court on any date without justifiable cause, the learned Trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.
The application for bail being C.R.M. (DB) No. 758 of 2025 is, thus, disposed of. Case Diary be returned.
