Mihir Khilari And ORS. v. State Of West Bengal And ANR.
C.R.R. 811 of 2022 18.12.2023 SL. 13 Court No. 34 Suvayan/ Sourav In Re: - An application under Sections 401 and 482 of the Code of Criminal Procedure.
And In the matter of: Mihir Khilari & Ors.
....petitioners.
Ms. Manisha Sharma ...for the State.
Records of the revisional application reflects that the revisional application appeared on 21.03.2022 and 24.03.2022 when none represented the petitioners.
Ms. Manisha Sharma, learned Advocate who ordinarily appears on behalf of the State is directed to represent the State. Her appointment may be regularized by the concerned Authorities in due course.
The subject matter of the revisional application relates to Sankrail P.S. case No. 114 of 2019 dated 19.09.2019 under Sections 498A/325/34 IPC read with Sections 3 and 4 of the Dowry Prohibition Act.
I have considered the contentions so advanced in the revisional application and I find that the petitioners approached this Court at the stage when charge-sheet was submitted and although copies and documents under Section 207 Cr.P.C. were supplied, but none of the documents were enclosed along with the revisional application.
Having considered the materials available before this Court and that the police authority arrived at a finding for prosecution of the present petitioners, I am of the view that the petitioners would be at liberty to take up the issues canvassed in the present revisional application before the learned Magistrate at the
appropriate stage of the trial of the case. No interference is called for in respect of the contention so advanced at this stage without the trial having progressed.
With the aforesaid observations, the present revisional application being CRR 811 of 2022 is disposed of. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
