This application has been filed for substitution of legal heirs of the deceased employee.

Mr. Sudipta Maiti, learned advocate appearing for the petitioner submits that, during the pendency of the writ petition, the employee has expired. Since the applicants, being the legal heirs, have a different cause of action, he seeks to withdraw the application with liberty to file afresh.

Accordingly, the application being CAN 1 of 2025 stands dismissed as withdrawn.

Liberty is granted to the applicants to file a fresh writ petition.

Mr. Maiti, learned advocate appearing for the petitioner informs the Court that the petitioner has already
expired and as such the writ petition has become infructuous.

In view of such submission, the writ petition being WPA 4801 of 2025 stands dismissed as infructuous. 7.
Interim order, if any, stands vacated.

All connected applications, if any, stand disposed of. 9.
Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
