W.P.A. 3735 of 2020 (Ajoy Das & Ors. vs. State of West Bengal & Ors.) Mr. Aslam Khan ....For the Petitioners Mr. Santanu Mitra .... For the State Affidavit of service filed on behalf of the petitioners is taken on record.

The petitioners seek liberty to submit an application for contract carriage permit before the Regional Transport Authority, Kolkata, the 2nd respondent herein. The petitioners allege that earlier application submitted by the petitioners was not accepted by the authority.

Such allegation is denied by the respondents. Upon consideration of the submission made on behalf of the parties, the writ petition is disposed of with liberty to the petitioners to file a fresh application for grant of contract carriage permit along with requisite fees before the 2nd respondent within a fortnight from date. The 2nd respondent is directed to consider and dispose of the said application within four weeks from

the date of receipt thereof upon affording reasonable opportunity of hearing to the petitioners, in accordance with law.

The decision taken by the authority shall be communicated to the petitioners within a week thereof. The writ petition is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
