The petitioners claim to be the employees of South Bengal State Transport Corporation. They allege that the employer has promoted the juniors by ignoring the claim of the petitioners. An objection of the petitioners with regard to this is pending consideration before the Managing Director of the Corporation.

Learned counsel for the Corporation seeks time to obtain instruction.

As it appears that the objection from the petitioners is pending consideration before the authority, accordingly, no useful purpose would be served by keeping the writ petition pending. 4.

The writ petition stands disposed of by directing the Managing Director of SBSTC being the third respondent to take a decision on the petitioners' representation strictly in accordance with the prevailing service rules guiding the petitioners at the earliest but positively within eight weeks from the date of communication of this order.

If the grievance of the petitioners is found to be proper, then necessary remedial steps shall be taken by the authority.

If required, an opportunity of hearing may be granted to the petitioners and any other affected party prior to passing the final order in the matter.

It is made clear that this Court has not entered into the merits of the claim of the petitioners and all points are left open to be decided by the aforesaid respondent at the time of consideration of the representation of the petitioners.

Learned counsel for the petitioners shall forward a copy of the subject representation along with all supporting documents to the aforesaid respondent at the time of communicating this order.

All parties are to act on the server copy of this order duly downloaded from the official website of this Court.

10.

Certified copy of this order, if applied for, shall be made available to the parties.
