Mr. Abhishek Halder Ms. Madhurima Basu ... for the petitioner By the order impugned, an ad-interim order of injunction was passed on an application under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure being moved in connection with Title Suit No. 1725 of 2024. The said order is an appealable order under the provisions of Order XLIII Rule 1(r) of the Code of Civil Procedure.

Faced with such situation, learned advocate for the petitioner prays for leave to withdraw this application with liberty to approach the appropriate forum.

In the light of the said submission, C.O. 727 of 2025 stands dismissed as withdrawn with liberty to the petitioner to challenge the said order before the appropriate forum in accordance with law.

The learned advocate for the petitioner is permitted to take back the certified copy of the order impugned upon furnishing a photostat copy of the same.

It is made clear that it will be open to the petitioner to raise all points before the appropriate forum. The application being CAN 1 of 2025 stands disposed of. (Hiranmay Bhattacharyya, J.)
