The petitioner has approached this Court as her representation dated 29.10.2023 was not considered by the Officer-in-Charge, Gaighata Police Station. The grievance of the petitioner is that there has been unnecessary interference with peaceful enjoyment of her property at the behest of the private respondent nos. 4 and 5 herein.

As none appears on behalf of the State, Ms.

Sanchayita De, learned advocate, who ordinarily appears for the State, is directed to represent the State. Her appointment may be regularised by the concerned authorities.

I have considered the grievance of the petitioner. So far as the boundary wall is concerned, the same would be subject to demarcation by the appropriate authorities or by the civil court. The police authorities are not empowered to interfere with the same. However, so far as peaceful enjoyment of the property is concerned, the police authorities would see that if

the situation till date persists, they would keep a strict vigil and ensure that no breach of the peace or tranquility takes place at the locale and/or any untoward incident results because of the strained relationship existing between the petitioner and the private respondents.

With the aforesaid observations, the writ petition being WPA 4989 of 2024 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
