Singh Ms. Richa Pramanik ...for the State The immediate grievance of the petitioner is that the Block Development Officer has not complied with the directions contained in the order dated 1st October, 2024 passed by a coordinate Bench in WPA 20268 of 2024. On the last occasion i.e. 9th March, 2026, Mr. Dutta, learned Advocate appearing for the petitioner submitted that though a hearing was conducted by the Block Development Officer on February 24, 2025, but no decision of such hearing has been communicated to the petitioner till date. Today, Mr. Singh, learned Advocate appearing for the State files a report containing the decision of the Block Development Officer, Bhagwanpur-I Development Block vide Memo dated 10th March, 2026, which is taken on record. The said Memo states that in accordance with the direction passed by the coordinate Bench, hearing was conducted on 25th February, 2025.
The Block Land & Land Reforms Officer submitted an inquiry report vide Memo dated 10th March, 2026 and in the said inquiry report, it has been stated that field verification confirms that there is no common passage for the public access to the disputed portion of the land. It further states that
according to the deed, the entrance of the land is situated along with plot no.172 i.e. the western side of the disputed portion and the recorded entrance is in the opposite direction of the PWD road.
Since the direction passed by the coordinate Bench has been complied with, nothing survives to be decided in this writ petition.
The writ petition is, accordingly, disposed of. The petitioner will be at liberty to work out the remedies freely in accordance with law.
