In view of the nature of the order proposed to be passed in the present application under Article 227 of the Constitution of India, service of notice of the application upon the opposite party is not necessary.

The petitioner is the defendant of a suit for declaration of title, the said suit being Title Suit No. 76 of 2002 is pending before the 4th Court of learned Civil Judge(Junior Division) at Burdwan, District-Purba Bardhaman.

The petitioner is complaining delay in disposal of the said suit and is praying for direction for expeditious disposal of it. It appears from the record that the witness action in the suit has commenced, the suit is pending since 2002, the learned Trial Judge is requested to dispose of the said suit as expeditiously as possible and in doing so, shall not grant any unnecessary adjournment to either of the parties.

C.O. 631 of 2024 is thus disposed without any order as to costs.
