16.03.2022 Ct. No. 29 KAUSHIK REJECTED C.R.M. (DB) 730 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Hasnabad Police Station Case No. 356 of 2020 dated 02.06.2020 under Sections 363/365/376/34 of the Indian Penal Code, 1860 and Section 6 of the Protection of Children from Sexual Offences Act. And In Re : Avijit Mondal ...... petitioner Mr. Kallol Kumar Basu Md. J. U. Firdous Ms. Tithi Majumdar ....for the petitioner Mr. Zareen N. Khan Mr. Ashok Das ....for the State Petitioner renews the prayer for bail.

Learned advocate appearing for the petitioner submits that, the petitioner is in custody for 319 days. Learned advocate appearing for the State draws the attention of the Court to the statement of the victim recorded under Section 164 of the Code of Criminal Procedure (Cr.P.C.). Considering the gravity of the offence and the complicity of the petitioner therein as transpiring from the 164 Cr.P.C. statement of the victim and considering the fact that there is hardly any change in circumstances since the earlier order of rejection, we are unable to grant bail to the petitioner.

In such circumstances, prayer for bail of the petitioner is rejected and the application being CRM (DB) 730 of 2022 is dismissed.
