Appellant has served out his sentence.

We have examined the evidence on record. PW 2 is the victim. She deposed on 16.11.16 at 12.45 PM she had gone out of her house with her mother-in-law for shopping. At that time appellant assaulted her with a knife in the neck. She suffered injuries. She was admitted at Habra Hospital and thereafter, she was shifted to R.G. College and Hospital. From the hospital she made statement to police. She identified the appellant in course of Test Identification Parade. Her deposition is corroborated by her mother-in-law (PW 3). Medical evidence on record i.e. PWs 9 to 14 and 16, doctors who treated the victim at Habra Hospital and R.G. Kar Medical College and Hospital have proved injuries on the victim. PW 15 was present when she made statement before police.

The aforesaid evidence unequivocally establish the guilt of the appellant. He has already served out the sentence. 4.

Under such circumstances appeal is dismissed. 5.

Lower court records along with a copy of this judgment be sent down at once to the learned trial Court for necessary action. 6.

Photostat certified copy of this order, if applied for, be given to the parties on priority basis on compliance of all formalities. I agree.
