Learned counsel appearing on behalf of the petitioners/applicants submits that the alleged contemnors have violated this Court's order passed on 29.01.2024 in WPA 1315 of 2024. Neither has the police kept the vigil as directed nor has the private respondent kept his undertaking before this Court that they would not block the egress and ingress to the chamber and residence of the petitioners.

Learned counsel appearing on behalf of the State/alleged contemnor No. 2 denies the allegations, relies on the report and submits that at present there is no commotion taking place at the place in question. There were instances of the priest of the temple, mistakenly playing the sound system once or twice.

Otherwise, there is peace in the area and the police are keeping a sharp vigil. Incidentally, the contemnor no. 3 has passed away and the contemnor no. 2 has been transferred.

It does not appear that there is a deliberate violation of the Court's order by the contemnor no. 2 or his successor in office. The contemnor no. 3 has passed away.

If there is any further disturbance caused by any of the heirs of the deceased contemnor, it shall be open to the petitioners to take appropriate steps for such fresh cause of action.

Therefore, no further order need be passed on this application.

Accordingly, the application of contempt is disposed of without any order, even as to costs. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. (Jay Sengupta, J.)
