Mr. Soumak Bera ...for the petitioner The petitioner is a retired employee of Kharagpur Municipality, having retired as a Clerk on January 31, 2018. Following his retirement, the petitioner was initially provided with an ad-hoc pension, and his regular pension commenced on December 18, 2019. The petitioner acknowledges that, thereafter, he began receiving his regular pension. On December 14, 2023, the petitioner submitted a representation to Kharagpur Municipality seeking arrear pension. The learned advocate representing the petitioner submits that this representation has not yet been considered.

I am not inclined to keep this writ petition pending.

I hereby direct Kharagpur Municipality to consider the petitioner's representation, dated December 14, 2023, in accordance with the law, after providing the petitioner an opportunity for a hearing. The Municipality shall issue a reasoned order and communicate the same to the petitioner.

This entire process must be completed within one month from the date of communication of this order.

Accordingly, WPA 5004 of 2024 is disposed of. Urgent certified photocopy of this order, if applied for, be supplied to the parties on compliance of usual legal formalities.
