C.R.M. (DB) 759 of 2025 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure read with Section 483 of the Bharatiya Nagarik Suraksha Sanhita, in connection with Santiniketan Police Station Case No. 143 of 2022 dated 18.09.2022.

And In Re :

Sufika Bibi @ Sarika @ Safika @ Rehena ... Petitioner Mr. Biswajit Hazra Mr. Sk. Nadeem Ahmed Mr. Syed M. Kabir ... for the Petitioner Mr. Avishek Sinha Mr. Abhishek Verma ... for the State The petitioner is in custody for more than two years and prays for bail.

Learned counsel for the petitioner submits that the deadbody of the victim was recovered from the asbestos roof of the house of the petitioner and her daughter to which no one has access. Further detention of the petitioner is not required.

Learned counsel for the State opposes the prayer and submits that the deadbody was recovered from the roof of the petitioner's house and the petitioner and her daughter murdered the child by strangulation due to grudge against the child's father. Only four more witnesses remain to be examined which can be completed in another schedule.

Considering the material on record directly implicating the petitioner in the alleged offence as well as the heinous nature of the offence, prayer for bail is rejected at this stage. Learned trial Court is directed to expedite the trial without granting any unnecessary adjournment to either of the parties.

The application is disposed of.

Case Diary is returned.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
