The authority had decided the matter on the basis of the representation. The representation is silent with regard to the alleged sale deed and the voter list. Even before the Bench, specific query was put to the learned Counsel for the appellant as to whether there is any specific averment in the representation which forms the basis of the challenge to the decision of the District Controller.

In absence of any such challenge thrown or shown as ground for cancellation of the licence, we do not find any reason to interfere with the order passed by the District Controller in rejecting the application of the petitioner.

Hence, the appeal and the connected application are dismissed.

However, there shall be no order as to costs.
