Be presenting this writ petition, inter alia, petitioner has prayed for sanction of post graduate scale of pay for obtaining Masters Degree in Sanskrit which is his relevant subject of teaching.

It is submitted on behalf of the petitioner that he was appointed in the post of Assistant Teacher on and from 6th October, 2009 and was sanctioned honours graduate scale of pay having honours graduate degree in Sanskrit. Subsequently, petitioner enhanced his qualification in 2018 by obtaining post graduate degree in Sanskrit from Rabindra Bharati University, Kolkata through distance mode of education.

It is submitted that in spite of repeated approach made by the petitioner to the concerned respondent authorities, till date decision has not been taken on the right of the petitioner to enjoy post graduate scale of pay. It is also submitted that last representation has been made on 24th January, 2025 claiming sanction of post

graduate scale of pay which is at pages 44 to 51 of the writ petition.

State respondents are represented by Mr. Basu Mallick, learned Additional Government Pleader who submits since issue is pending before District Inspector of Schools (S.E.), Nadia, the same needs to be decided in accordance with law.

Having considered the submissions made on behalf of the parties, writ petition stands disposed of directing the District Inspector of Schools (S.E.), Nadia being respondent no.3 to decide the representation of the petitioner dated 24th January, 2025 by eight (8) weeks from the date of communication of this order after granting opportunity of hearing to the petitioner or his representative. The decision to be taken by respondent no.3 shall be communicated to the petitioner by one (1) week thereafter.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
