This is an application challenging the issuance of warrant of arrest against the present petitioner.

Let a copy of this application be served upon Mr. Swapan Banerjee and Ms. Baisali Basu, learned Counsels who ordinarily appear on behalf of the State. Let them represent the State. Their engagement may be regularised by the competent authority of the State in due course. Learned Counsel appearing on behalf of the petitioner submits as follows. The petitioner is the accused in this case. He was granted anticipatory bail by this Court on 23.12.2019. He obtained regular bail on 06.01.2020. Thereafter, he started attending the learned Trial Court. However, on 28.01.2022, although his learned Advocate had prayed for time, a warrant of arrest was issued against him for his absence. The petitioner wants to join the proceeding at the earliest.

Learned Counsel appearing on behalf of the State submits that the petitioner should surrender before the learned Trial Court at the earliest. I have heard the learned Counsels appearing on behalf of the petitioner and the State and have perused the revision petition. It appears that the petitioner was granted anticipatory bail by this Court. Thereafter, he obtained bail and started attending the learned Trial Court. However, on a particular occasion, he prayed for time. Yet, a warrant of arrest was issued.

The warrant of arrest issued against the petitioner shall remain stayed for a period of four weeks from this date. The petitioner shall surrender before the learned trial Court within such time. In the event the petitioner surrenders before the learned Trial Court within the stipulated period of four weeks and prays for bail, his application for bail shall be considered in accordance with law. With the above observations, the revisional application is disposed of.
