1. Affidavit of service filed on behalf of the petitioner is taken on record.

2. It is submitted by the learned advocate representing the petitioner that private respondents are staying at the residence of the petitioner without any authority.

3. Prayer is made for issuing mandamus directing the police authority to evict the private respondents from the premises of the petitioner.

4. State respondents are represented by learned advocate who has submitted that the issue involved in this writ petition is civil in nature requiring the petitioner to approach the civil court for remedy.

5. Private respondents are represented by learned advocate who has submitted that they are staying at the premises for a long period of time and submission of the petitioner is disputed by the learned advocate representing the private respondents that unauthorisedly they are staying at the residence of the petitioner.

6. Having considered the respective submissions made on behalf of the parties Court finds that the issue involved in this writ petition is civil in nature which ought not to be delved into in this writ petition.

7. Hence, the writ petition stands dismissed.

8. However, this order shall not preclude the petitioner to take steps in accordance with law.

9. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
