It appears from the record that on the date fixed for evidence of the defendant's witness an application under Order 6 Rule 17 of the Code of Civil Procedure was filed and same has been fixed for hearing on 8th May, 2025. In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite party. However, the learned advocate appearing for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing them before the learned trial judge.

Since the application under Order 6 Rule 17 of the Code of Civil Procedure is fixed for hearing on 8th May, 2025, C.O. 735 of 2025 is disposed of by requesting the

learned Civil Judge ( Senior Division) Sealdah to take up the hearing of the said application on the next date i.e. on 8th May, 2025 and to dispose of the same without granting any unnecessary adjournment to either of the parties. After disposal of the said application the learned Civil Judge shall make an endeavour to see that the Money Suit no. 46 of 2016 is disposed of expeditiously without granting any unnecessary adjournment to either of the parties.

No order as to costs.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
