The grievance of the petitioner is directed against the failure to remove of an electricity connection installed at the premises of the petitioner. The Distribution Company is represented and submits that installation of the aforesaid electricity connection was with the consent of the petitioner and the petitioner now seeks removal of the same. The private respondents are represented and submit that the electrical installation has taken place on their premises and not the premises of the petitioner.

In view of the disputed question of facts which arise for consideration, I am of the view that the matter be remanded to the concerned District Magistrate to consider the grievances of the petitioner.

The petitioner is directed to implead the District Magistrate as a party respondent to the writ petition within the course of the day.

The District Magistrate is directed to consider the grievances of the petitioner and give a right of hearing to all the affected parties and dispose of the representation of the petitioner within a period of twelve weeks from date.

Liberty is granted to the petitioner to file a representation with the concerned District Magistrate within a week from date.

With the aforesaid directions, WPA 5461 of 2021 is disposed off.
