Mr. Shibaji Kumar Das, Ms. Rupsa Sreemani ... for the petitioner Ms. Parna Roy Choudhury ... for the respondent Bank The urgency of the petitioner is that the respondent Bank issued a Notice of Sale dated 3rd February, 2023 fixing the sale for today, i.e. 28th February, 2023. The impugned Notice was posted by the respondent Bank on 6th February, 2023 and received by the petitioner on 14th February, 2023. The petitioner thereafter approached the statutory forum, i.e. the Debts Recovery Tribunal but was unable to obtain a S.A. Case number. The reasons for the petitioner's inability to obtain a S.A. Case number are stated in the supplementary affidavit filed by the petitioner.

Whatever be the present difficulties faced by the petitioner, learned counsel for the respondent Bank

submits that the Sale has failed due to lack of sufficient number of bidders.

Nothing further remains to be adjudicated in the writ petition.

WPA 4749 of 2023 is disposed of in terms of the above.
