Ms. Upama Bhattacharjee... For the Petitioner. In view of the order proposed to be passed in the present application under Article 227 of the Constitution of India, service of notice of the application upon the opposite parties is not necessary.

The plaintiff, the petitioner herein is praying disposal of the connected Ejectment Suit No. 102 of 2004 pending before the learned Judge, 5th Bench, Small Causes Court, Calcutta. Learned advcoate for the petitioner submits that the delay complained of has been caused due to pendency of an application filed by the defendants for transfer of the suit to the Commercial Court, the said application though was filed on December 12, 2022 but the same has not yet been disposed of.

Learned advocate for the petitioner further submits that the hearing of the said application has commenced today, she prays for a direction for expeditious disposal of it. The said pending application, by its nature, deserves early disposal, the learned Trial judge therefore, is requested to dispose of the said application as expeditiously as possible in accordance with law and depending on the outcome of the said application, shall expedite the disposal of the suit.

The learned Trial Judge, in doing so, shall not entertain the prayer of the parties for any unnecessary adjournment. The petitioner is required to communicate this order to the defendants before the next date fixed in the suit. C.O. 641 of 2024 is thus disposed without any order as to costs.
