Mr. Gouranga Kumar Das .....for the petitioner Ms. Sujata Das .....for the State This is an application seeking expeditious disposal in a case where a charge sheet was submitted under Sections 408, 420 read with Section 120B of the Penal Code.

Let a copy of this application be served upon Ms. Sujata Das, learned counsel, who is present in court today and who ordinarily appears on behalf of the State. Her engagement may be regularised in due course by the competent authority of the State.

Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is an accused in this case. The FIR in this case was lodged on 29.12.2009. A charge sheet was submitted in 2010 and the charges were framed in 2014. The prosecution intends to examine 6 witnesses in this case. Several dates were fixed for during trial. Yet, only 2 out of a total of 6 witnesses could be examined in this case. The proceeding has remained pending for no fault of present petitioner.

Learned counsel for the State submits that the State would not come in the way if a direction is passed

to expedite the trial.

I have heard the submissions of the learned counsels appearing on behalf of the petitioner and the State and perused the revision petition.

It appears that an inordinate delay has been occasioned in concluding the proceeding, especially considering the fact that the FIR in this case was lodged way back in 2009.

In view of the above and in the interest of justice, I request the learned trial court to conclude the proceeding as expeditiously as possible without granting any unnecessary adjournment to any of the parties and by invoking necessary coercive measures to ensure the attendance the accused, preferably within a period of one year from the next date of hearing.

With these observations, the revisional application is disposed of.
