The petitioner is in custody for more than 100 days and prays for bail.

Learned counsel for the petitioner submits that the petitioner is not the principal assailant and had only accompanied his father who dealt the fatal blow.

Learned counsel for the State opposes the prayer. I have perused the material on record.

The petitioner who is one of the sons of the principal accused appears to have assaulted the victim with lathi and rods. The victim succumbed to his injuries.

Considering the prima facie involvement of the petitioner in the alleged offence as well as gravity of the offence, the prayer for bail is rejected at this stage.

The application for bail is disposed of.
