The petitioner claims that he has not received the second entitlement under Career Advancement Scheme of the State applicable to SBSTC. He has made a representation in this regard which remains unconsidered. Mr. Banerjee, Learned Counsel for the Corporation submits that the petitioner has received the first entitlement under the Career Advancement Scheme on 21st September, 2003. The same was given effect to in the year 2017.

It is further submitted that the second increment was allowed to the petitioner on 28th September, 2013 which could not be given effect to in view of the pending departmental proceedings. It is submitted that the second increment has also been allowed to the petitioner in the year 2020 when the order in question was signed. It is

submitted that the petitioner must have been allowed such benefit.

It is, therefore, ordered that the petitioner shall be allowed the benefit of the second increment under the aforesaid scheme unless already given to him, as expeditiously as possible, preferably within a period of two months from the date of communication of the copy of this order.

Needless to mention that the Corporation as well as the petitioner shall verify the respective documents and confront each other evidence in this regard, in the event of any dispute.

With the above observations, WPA/3759/2020 is dispose of.

The communication as regards the implementation of the Career Advancement Scheme in the Corporation insofar as the petitioner is concerned is kept on the record.

Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
