Present petition has been filed for expeditious disposal of G.R. Case No.5041 of 2012 arising out of Ashoknagar P.S. Case No.523 of 2012 under Section 498A/34 IPC pending before the learned Additional Judicial Magistrate, Barasat Court, North 24 Parganas.

Learned counsel for the petitioners submits that in the last 13 years, the case has not seen any progress. The petitioners are stated to be senior citizen.

The court considers that no prejudice to be caused either of the parties if an appropriate direction is issued for the expeditious disposal. The speedy and fair trial is a facet of fundamental right.

Thus, taking into account and facts and circumstances, the learned Additional Judicial Magistrate, Barasat Court, North 24 Parganas is directed to conduct the proceedings expeditiously in G.R. Case No.5041 of 2012 in accordance with the law.

Accordingly, CRR 969 of 2025 stands disposed of. 6.
