Mr. Sandip Das ...for the petitioner Mr. Subhabrata Datta, Mr. Sanatan Panja ...for the State Counsel for the petitioner submits that the private respondents have illegally filled up a pond and have effected construction thereon. The nature and character of the land has not been changed. This Court is of the view that the remedy of the petitioner is before an appropriate civil or statutory forum against the action of the private respondents.

Police have taken out proceedings under Section 107 of the Cr. P.C.

The petitioner may avail the other remedies available as indicated hereinabove.

The Kakdwip Police Station, South Parganas shall, however, ensure that there is absolutely no breach of peace in the area.

With the aforesaid observations, the instant writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
