The present revisional application has been preferred challenging the proceedings relating to Daspur Police Station Case No. 18 of 2012 dated January 28, 2012.
Records reflect that chargesheet was submitted in connection with the said case on or about 30th May, 2014 under Sections 399/402 of the Indian Penal Code and Section 9(b)of the I. E. Act. . Having regard to the contentions advanced on behalf of the petitioner, I am of the opinion that the same related to question of facts. The issue raised is that only three accused persons have been named in the chargesheet and the allegations do not satisfy the definition of dacoity is also not acceptable in view of the fact that in the chargesheet as well as in the FIR it has been stated that other persons are also involved. .
Petitioner is granted liberty to canvass the points advanced in the revisional application at the appropriate stage of the proceedings.
With the aforesaid observations, the present revisional application being CRR 532 of 2021 is disposed of. Pending applications, if any, are consequently disposed of.
