Affidavit-of-service filed in Court today is taken on record.

None appears on behalf of the respondents in spite of service.

The grievance of the petitioner is that even though the fees for approval of the building plan and the fees for donation regarding development of their own fund has been received by the Sarberia-I Gram Panchayat way back on 3rd April, 2019 no steps have been taken by the Panchayat to approve the building plan.

The petitioner made a representation praying for approval of the building plan by a letter dated 30th January, 2020.

The petitioner complains that even thereafter the Gram Panchayat did not take any step for approving the building plan.

According to the provisions of law, the Gram Panchayat on receipt of an application, after making such enquiry shall, by order in writing either grant the

permission or refuse it, recording in the case of refusal the reasons therefor.

The Panchayat ought not to sit tight over the matter for such a long period of time.

In view of the above, the instant writ petition is disposed of by directing the respondent No.3, Sarberia-I Gram Panchayat, Daspur-1 through its Pradhan being the respondent No.4 herein to take necessary steps for consideration of the building plan submitted by the petitioner and take necessary steps in the matter at the earliest, but positively within a period of sixty days from the date of communication of a copy of this order. In the event the authority opines not to approve the plan, then the reasons for disapproval shall be made known to the petitioner immediately thereafter. WPA 3785 of 2020 stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
