Re : CAN 1 of 2023 This is an application for restoration of the writ petition which was dismissed for default by an order passed on March 13, 2023.

Sufficient grounds being made out, the application is allowed. The order passed on March 13, 2023 is set aside. The writ petition being WPA 4777 of 2023 be restored to its original file and number.

The application being CAN 1 of 2023 is disposed of. Re : WPA 4777 of 2023 By consent of the parties, the writ petition is taken up for hearing.

Affidavit of service filed by the petitioner is taken on record.

None appears for the private respondent despite service.

Heard learned counsels for the parties.

The innocuous prayer of the petitioner is for consideration of the objection filed by him against the revised timetable for bus no. WB-33B/1830 for the route Manbazar to Kharagpur.

Learned counsel for the respondents submits that the 3rd respondent be directed to consider and dispose of the objection in accordance with law.

In view of the above, the writ petition is disposed of directing the 3rd respondent to consider and dispose of the objection filed by the petitioner dated 11th May, 2022 within one month from the date of communication of this order upon affording reasonable opportunity of hearing to all the interested persons including the petitioner and the private respondent, in accordance with law.

The decision taken by the authority shall be communicated to the petitioner within a week thereof. With the above directions, WPA 4777 of 2023 is disposed of.

There shall however, be no order as to costs. Since no affidavit in opposition is invited, the allegations contained in the petition are deemed not to be admitted.
