This writ-petition has been filed by the petitioner against non-consideration and sitting over his representation dated May 19, 2015 being annexure P-4 to the writ-petition, making claim of permanent absorption against the vacant posts. Learned Advocate appearing for the respondent nos. 4 & 5, submits that this writ-petition is not maintainable since on the selfsame cause of action, the petitioner has filed another writ-petition being 12640 (W) of 2013, which is still pending. Learned Advocate appearing for the petitioner submits that his client will not pursue the writ-petition being WP 12640 (W) of 2013 and withdraw the same.

Considering the submissions of the parties, this writpetition is disposed of by directing the District Inspector of Schools, SE, Nadia being respondent no. 3, to consider and dispose of the aforesaid representation being annexure P-4 to the writ-petition in accordance with law and by passing a reasoned and speaking order and giving opportunity of hearing to the petitioner or her authorized representatives, within eight weeks from the date of communication of this order and communicate his decision to the petitioner within two weeks thereafter.

Let it be recorded that this Court has not gone into the merit of the case and the respondent no. 3 shall dispose of the said representation by applying his judicial mind. With the aforesaid directions the writ-petition being WPA 3758 of 2019 is disposed of.
