The writ petitioner is aggrieved that despite an order dated 15.03.2019 of Co-ordinate Bench in this proceeding, the private respondents have not only encroached the property but have made permanent constructions thereat. In T. S. 73 of 2014, the petitioners were granted declaration of title by the learned Civil Judge(Senior Division) under the WBLR Act.

It is submitted that the appeal is pending before this Court against the order in respect of the Preemption Misc. Case No. 25 of 2011.

It is submitted by the Arambagh Police Station in terms of the instructions dated 13.11.2022 addressed to the State advocate that FIR 225 of 2019 dated 12.06.2019 has been registered and has resulted in charge sheet being Charge Sheet No. 245 of 2019 dated 30.06.2019.

In view of the above, this Court finds no inaction on the part of the Arambagh Police Station. The

instructions of I. C., Arambagh Police Station dated 13.11.2022 is taken on record.

The writ petition is disposed of.

There will be no order as to costs.
