This writ petition relates to payment of gratuity. It was filed by the employer against the Certificate Officer. However, in the meantime the employer has paid the total dues as was assessed by the Certificate Officer with 10 per cent interest by two cheques one dated 19th January, 2021 and the other dated 19th February, 2021. He also submits that those two cheques has been encashed by the private respondent being the employee. However, in this matter an appeal was preferred by the petitioner wherein the Division Bench directed the Certificate Officer to go into the question of claiming of the compound interest.

It is submitted that the Certificate Officer has already given one hearing on 10th February, 2021 and today another date of hearing is fixed at 2 P.M. before him.

I find that as of now there is no disputes so far as the writ application is concerned. Hence, the writ petition along with the application being CAN 1 of 2021 are disposed of and is expected that the Certificate Officer will perform his duty according to the direction given on him by the Appeal Court.

There shall, however, be no order as to costs. (Abhijit Gangopadhyay, J.)
