Learned advocate appearing for the petitioner submits that the petitioner is in custody since 15.10.2022 i.e. for more than 16 months and till date, after framing of the charges, examination of the witnesses has not commenced. Learned advocate submits that 11 witnesses have been relied upon by the prosecution in order to prove its case and the next date has been fixed on and from 09.05.2024. Having considered the number of witnesses to be examined and the period of detention of the present petitioner, I direct the learned Special Court to fix a schedule of three dates and fix such schedule once in every 45 days so that trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournment should be granted to either of the parties. In case any witness is absent, the office of the Superintendent of Police, Uttar Dinajpur be communicated. The concerned office of the Superintendent of Police will revert back, in case any witness is not available or in the alternative will ensure regarding the availability of the witness concerned.

The learned Special Court will not accept any frivolous grounds for absence of the witness.

Learned public prosecutor conducting the case would ensure regarding the production of materials, documents and exhibits on the dates so fixed for examination of the witnesses.

All stakeholders should cooperate with the learned trial court to conclude the trial at the earliest.

With the aforesaid observations, the revisional application being CRR 841 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
