Affidavit-of-service and receipt of notice filed in court today be kept on record.

Learned counsel for the petitioner fairly submits that the petitioner has also preferred a statutory appeal against the impugned order of cancellation of the gun licence of the petitioner.

Accordingly, on the prayer of the petitioner, WPA 5142 of 2024 is dismissed as withdrawn with liberty to the petitioner to prosecute the present challenge before the appellate forum where the petitioner's appeal is already pending.

If so proceeded with, the appellate forum shall decide all issues involved without being influenced in any manner by the present rejection.

This court has not gone into the merits of the case at all.

It is expected that in view of the petitioner's perceived life threat, the appellate forum shall decide the appeal as expeditiously as possible and in accordance with law, preferably within one month from the date of communication of this order to the said tribunal.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
