The writ petitioner is aggrieved by the fact that he had applied and submitted his bid under a tender for construction of additional class room at Manik Chak Junior High Madrasah, Lalgola. The writ petitioner claims to be the lowest bidder. Despite whereof, the petitioner did not receive any work order from the respondents and represented, inter alia, to the concerned B. D. O. on 14.02.2020.

The concerned B. D. O. had cancelled the earlier tender and issued fresh notice inviting tender. This Court is of the view that Tender Inviting Authority has the discretion to cancel tender and the same cannot be disputed.

In that view of the matter, no interference is called for in the instant writ petition.

With the passage of time, it is reasonably suspected that the new tender process may have been completed by this time.

The writ petition is disposed of without any order.

There will be no order as to costs.
