Challenging an order passed in a proceeding under Section 125 of the Code of Criminal Procedure, the petitioner/husband had preferred this revisional application. The matter was listed for hearing on several occasions, however, the petitioner failed to appear. The report of the Assistant Registrar- XII indicates that an administrative notice was sought to be served upon the petitioner by the Registry of this Court. However, the personnel entrusted with the task of effecting such service ascertained that the petitioner, namely Dulal Chandra Brahma, had already passed away, and his family members declined to acknowledge or sign any document in connection with the notice. It is also noted that the matter has been pending before this Court for a considerable period of time. In view of the above, I am of the opinion that with the passage of time, the matter has become infructuous. Accordingly, the revisional application being CRR 1388 of 1992 is dismissed.
