It has been brought to the notice of the Court that challenging the order passed by the Maintenance Tribunal, the petitioner has already approached the appellate forum.

In view of the same, the instant writ petition stands dismissed.

It will be open for the petitioner to proceed with the appeal in accordance with law.

The petitioner shall, however, continue paying the maintenance amount as directed by the Maintenance Tribunal till the order is vacated/modified or varied by the appellate forum.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
