CRM (A) 1276 of 2022 16.03.2022 Sl. 37 Court No.29 suvayan (Rejected) In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Harishchandrapur P.S. Case No.
of dated 17/01/2022 under Sections 341/324/195A/34 of the Indian Penal Code, 1860. And In the matter of: Tohara Bibi & Ors.
....petitioners.
Mr. Soupal Chatterjee Ms. Promita Banerjee ... for the petitioners.
Mr. Ranabir Chowdhury Mr. Sandip Chakraborty ...for the State.
Petitioners seek anticipatory bail.
Learned Advocate appearing for the petitioners submits that petitioners were falsely implicated.
Learned advocate appearing for the State draws the attention of the Court to the injury report of the victim and the statements recorded under Section 161 of the Criminal Procedure Code. It appears from the records that all the petitioners were on bail in a previous police case. The petitioners thereafter assaulted the victim.
Considering the gravity of the offence and the involvement of the petitioners therein and considering the fact that the petitioners were on bail when they participated in the incident and considering the injury report of the victim, we are unable to grant anticipatory bail to the petitioners.
The application for anticipatory bail, being CRM (A) 1276 of 2022, is rejected.
