Shibpur, DistrictHowrah, PIN-711102. Today, the petitioner has forwarded a communication to the Advocate on Record mentioning that he intends to withdraw the writ petition. Fact remains that the complaint filed by the petitioner alleging unauthorised construction is

pending consideration at the end of the Howrah Municipal Corporation.

The Howrah Municipal Corporation is directed to cause a spot inspection of the property upon prior notice to the parties and to ascertain as to whether there is any unauthorised construction as alleged or at all.

As the petitioner has expressed his unwillingness to proceed with the writ petition, the writ petition stands dismissed as 'not pressed'.

Dismisal of the writ petition will however, not prevent the Howrah Municipal Corporation to take steps in the matter in accordance with law if it is found on inspection that there is any unauthorised and illegal construction made in the said premises. Necessary steps shall be taken by the Howrah Municipal Corporation to deal with such unauthorised construction.

Communication made by the petitioner to the learned advocate dated 6th September, 2022 be retained with the records.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
