Criminal Revisional Jurisdiction CRR 292 of 2015 In re. An application under Section 401 read with Section 482 of the Cr.P.C.

In the matter of: Karim Khan @ Abdul Karim Khan ... petitioner The subject-matter of the revisional application relates to the order dated 10.12.2014 passed by the learned Additional Sessions Judge, Bolpur, Birbhum in connection with Sessions Case No.63 of 2008.

The order so challenged reflects that the Public Prosecutor filed an application under Section 321 of the Cr.P.C. which was rejected by the learned Court and thereafter learned Court proceeded the summon to the witnesses for ensuring appearance on the date fixed for evidence.

Records of the revisional application reflect that on 01.04.2015 the revisional application appeared before the Coordinate Bench, however none represented the petitioner. Today also when the matter has been called, no one represented the petitioner.

As none appeared on behalf of the State, Mr. Anwar Hossain along with his junior Ms. Debjani Sahu who ordinarily appears on behalf of the State, is directed to appear in this matter on behalf of the State. Let his appearance be regularised by the concerned authorities.

Having regard to the subject matter of challenge, I am of the opinion that there is no illegality by the Trial Court in proceeding with the sessions case.

Thus, no interference is called for.

Accordingly, CRR 292 of 2015 is dismissed, pending application if any is consequently disposed of, interim order if any is hereby vacated.

All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this Court.
