The allegation against the petitioner is under Sections 363/366(A)/368/34 of the Indian Penal Code. Learned advocate for the petitioner submits that the petitioner is a housewife and has been falsely implicated in the case. She has no connection with the commission of the alleged offence.

We have heard the Learned Public Prosecutor and perused the material in the case diary. Prima facie, we do not find sufficient incriminating material against the petitioner.

Considering the nature and gravity of the charge and the overall facts and circumstances of the case, we are inclined to allow the petitioner's prayer for anticipatory bail. Accordingly, in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of

Rs.10,000/- (Rupees Ten Thousand), with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer of the concerned police station and shall abide by the conditions laid down in Section 438(2) of the Code of Criminal Procedure until further orders and on further condition that the petitioner shall not enter the jurisdiction of Berhampore Police Station until further orders. The petitioner shall also furnish the address where he will be residing to the Investigating Officer.

The application for anticipatory bail being CRM 2110 of 2021 is, thus, allowed.
