Mr. Subrata Bhattacharjya ...for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Jr. Div.), 1st Court, Barasat to dispose of Title Suit No.632 of 2013 expeditiously.

In view of the order sought and proposed to be passed this Court feels that there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate on record of the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocates representing the opposite parties before the learned Trial Judge.

From the order sheets appended to the civil revision application this Court finds that April 28, 2025 has been fixed for hearing of the application under Order 6 Rule 17 of the Code of Civil Procedure filed by the defendant/opposite party herein.

The learned advocate appearing for the petitioner submits that the written objection to the amendment

application has already been filed and the said application is otherwise ready for hearing.

In the light of the aforesaid submissions made by the learned advocate for the petitioner CO 744 of 2025 is disposed of by requesting the learned Civil Judge (Jr. Div.), 1st Court, Barasat to take up the hearing of the application under Order 6 Rule 17 of the Code of Civil Procedure on the next date fixed i.e., on April 28, 2025 and to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties. After disposal of the interlocutory application the learned Civil Judge shall make an endeavor to see that Title Suit No.632 of 2013 is disposed of expeditiously. There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
