1. In view of the fact that the workman was engaged as a Khalasi of the vehicle in question that was insured and there are clinching evidence to suggest that before such accident he was receiving the wages @Rs.6,000/- per month, the compensation amount awarded is inconformity with law and does not call for any interference. Hence, the appeal stands dismissed.

2. The compensation amount deposited shall be released in favour of the claimant within twelve weeks from the date of communication of this order by the appellant.

3. In addition to the aforesaid, the department concerned is directed to immediately communicate this order to the learned Court of Commissioner (WC), West Bengal for information. (Soumen Sen, J.) (Apurba Sinha Ray, J)
