The present revisional application was preferred challenging the order dated 27-01-2011 passed by the learned Judicial Magistrate, Fifth Court, Chinsurah, Hooghly (Sadar) in CR Case No.325 of 2005 under Sections 420/406/120B of the Indian Penal Code.
I find that the subject matter of challenge relates to an application under Section 245(3) of the Code of Criminal Procedure being allowed by the learned Magistrate. Having considered the reasons which have been assigned by the learned Magistrate and the time which has elapsed in the meantime, which is more than ten years, I am of the view that interference at this belated state would be prejudicial to either of the parties. Accordingly, no interference is called for.
CRR 649 of 2011 is dismissed. Pending application, if any, is consequently disposed of. Interim order, if any, stands vacated.
