I have considered the representation made by the Alipore Bar Association against the respondent no.7, who is the Officer-in-Charge, Ekbalpore Police Station. I do not find any specific accusations being made in respect of a particular incident and there are bald allegations against the respondent no.7. The said representation was addressed to all the higher officials of the police administration.

Petitioners lastly pray that the petitioners have been falsely implicated in criminal cases by Ekbalpore Police Station. Truth or falsity of the allegations at the stage of investigation cannot be entertained by a court of law for quashing the proceedings. Since the representation has been made

to the superior officer of police, it is for them to consider the representation. This Court will not invoke its powers under Article of the Constitution of India for act and actions which are not substantiated in respect of steps taken by the police authorities.

With the aforesaid observations, WPA 5222 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

Needless to state that since no affidavit has been called for, the allegations made in the writ petition are deemed not to have been admitted. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
