For the Respondent bank Learned counsel appearing on behalf of the State Bank of India submits on instruction that during the pendency of the appeal the matter has been settled between the parties and "No Due Certificate" has been issued in favour of the appellant no. 1. The document dated 2nd November, 2012 filed in court indicates that the matter has been settled between the parties and the same is kept with the record.

In view of the above, the appellants are not interested to proceed with the appeal. In this regard a photostate copy of letter dated 6th January, 2023 is addressed to Mr. Sayantan Bose, learned advocate on record of the appellants, requesting to withdraw the appeal and the same be kept with the record.

In view of the above submission, the appeal is disposed of by recording settlement.

In view of the aforesaid order the application for stay being CAN 5273 of 2011 is also disposed of on the basis of such settlement.

Interim order, if any, stands vacated.

There will be no order as to costs.
