REJECTED C.R.M.(A) 725 of 2024 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Goalpokher Police Station Case No. 75 of 2023 dated 18.02.2023 under Sections 147/148/149/326/307/302/34 of the Indian Penal Code under Sections 25(1A)/27/35 of the Arms Act, 1959.

Nazar Chowdhury ...for the defacto-complainant Petitioner was named in the First Information Report and a statement recorded under Section 164 of the Cr.P.C. by eyewitness as a person who played an active role in the murder. The police case is one of murder. Two persons were murdered. Materials in the case diary suggest active role of the petitioner in the incident of murder.

Consequently, we are unable to grant anticipatory bail to the petitioner and the prayer for anticipatory bail is rejected.
