1. Affidavit of service, as filed, be kept with the record.

2. The petitioner is aggrieved that his services as a Guest Teacher at the Government Model School, Kaliachak-III, Malda was discontinued in view of the appointment of the respondent no. 6 as a Regular Teacher in the same School. Further, the joining of the respondent no. 6 in the School on a declared holiday or at least on a day when the School was closed is prima facie, impermissible in law.

3. The petitioner had made multiple representations before the Deputy Director of Education as well as before the respondent no. 4. The order dated 17.11.2025 of the respondent no. 4, though extremely vague, does touch on the issue of validity of the joining by the respondent no. 6 in the said School.

4. The representation of the petitioner before the Deputy Director of Education on 15.12.2025 has not been considered at all. Without any consideration, the Deputy Director proceeded to issue an order, merely recording the joining of the respondent no. 6 on 21.11.2025.

5. In view thereof, I direct the Deputy Director of School Education (Boy's High), West Bengal, having its office

P a g e | 2 at Bikash Bhavan, Salt Lake, Kolkata 700091, to consider the representation dated 15.12.2025 made by the petitioner, particularly, in the light of the fact that the joining/rejoining of the respondent no. 6 in the School on a date when the School was closed is valid or not.

6. The representation will be considered and disposed of by the Deputy Director by 10.04.2026 upon giving a hearing to the petitioner with adequate prior notice.

7. The Deputy Director will communicate the resultant order to the petitioner by 20.04.2026.

8. With these observations, WPA 4970 of 2026 is disposed of.
